Sega and Gearbox Software are the defendants in a class action suit claiming that the two companies falsely advertised Aliens: Colonial Marines in the trade show demos when compared to the final product.
When the title was released on February 12, 2013 a sea of negative reviews flooded the internet, some critics and players claimed that the final product didn’t match the trailers and demonstrations shown throughout it’s development. The lawsuit’s plaintiff, Damion Perrine, as well as the law firm of Edelson LLC decided to take the matter to court for consumers stating that “We think the video game industry is no different than any other that deals with consumers” if companies like Sega and Gearbox promise their customers one thing but deliver something else, then they should be held accountable for thhat decision”.
In a tweet from Gearbox Software CEO, Randy Pitchford, stated that the complaints were “understood and fair”. The claims suggest that the demos that were labeled “actual gameplay” were misleading. It’s also inferred that Sega restricted press reviews until the game was released early in the morning and preventing consumers from learning about the differences. The suit is asking for class action damages for those who purchased the game the day on it’s release date or preordered it and then purchased the game.
